This is a translation for convenience. In case of doubt, the German version applies.
1Scope#
These terms apply to the use of the website winku.de (opens in a new tab), to a user account created there, to the programs offered by Winku (currently Dubster, WinkuStore, CueUp, Luvia) and to the services usable in the browser (currently Vidono, WinkuBot, Nivo, Wovia, WatchMod, Showdown, Wink). The provider is the operator named in the legal notice. Deviating terms of users do not apply.
2Services and availability#
The programs, the user account and the use of the website are free of charge. For individual services, paid access may be offered; price, term and conditions are displayed before purchase. At present no such access can be purchased. In addition, individual services facilitate paid transactions between users; details are set out in the description of the respective service (currently Vidono, see section 8a). There is no entitlement to a particular level of availability, to individual features or to continued operation. Maintenance, changes and discontinuation of individual services are possible at any time; we announce planned work on the website where feasible.
3User account#
Some features require a free account. Details provided must be accurate, credentials must be kept secret and must not be passed on. One account per person. The account can be deleted at any time without giving reasons; we may suspend or delete accounts if these terms or applicable law are breached.
3aSigning in with accounts from other providers#
Instead of an e-mail address and password, you can create and use your user account via an existing account from another provider (currently Twitch, Discord, Google, Microsoft, GitHub, GitLab, Amazon, Spotify, PayPal, Kick, Dropbox, Patreon, Epic Games, Steam, Telegram, Lichess, Roblox, Wikipedia, itch.io (opens in a new tab), X, TikTok and Minecraft (Java and Bedrock); the sign-in page shows which of them are offered). The terms of the respective provider apply in addition, and you are responsible for complying with them.
Signing in via a provider is optional and only replaces the way into the account: it creates the same Winku account with the same rights and obligations as registering with an e-mail address. Which details we receive is described in sections 15a, 15d and 15m of the privacy policy. An account is only created after you have confirmed your e-mail address with a code sent to it and accepted these terms. The details must be true; one account per person is sufficient.
We receive neither your password at the provider nor the right to do anything there on your behalf. Nothing is paid and no contract with PayPal or Amazon is concluded through signing in with them.
You can disconnect connections in your account at any time and add new ones. So that you are not locked out, at least one way to sign in always remains. If a provider suspends or deletes your account there or discontinues its sign-in interface, you can no longer sign in that way; your Winku account is not affected and remains accessible via another option or via "Forgot password" to your e-mail address. There is no entitlement to any particular provider being offered. Winku has no business relationship with the providers and is neither endorsed nor reviewed by them; their names are trademarks of their owners.
4Use of the programs#
The programs may be used free of charge, privately and commercially. The part of the programs written by Winku itself is not open source; in that respect, removing or circumventing security features (such as signature verification), altering the installation files, distributing modified versions and reselling are not permitted. Reverse engineering is permitted only to the extent mandated by law.
The programs contain third-party components under free licences, in particular under the GPL and the LGPL. For these components only the respective licence terms apply; they grant you further rights — including the right to modify and to distribute modified versions. The preceding paragraph does not restrict these rights. Which components these are, which licence they are under and where you can obtain the corresponding source code is set out at winku.de/en/licenses (opens in a new tab).
5User content#
The person posting is solely responsible for uploaded or created content (reviews, profile pictures, shared files). Unlawful, abusive or infringing content must not be posted; in particular, third-party copyright must not be infringed. Reviews and profile pictures are checked before publication. We may remove content without prior notice where a breach exists or is reasonably suspected. By posting, you grant us the simple, revocable right to display the content within the service.
6Shared files#
Files provided via the sharing function are publicly accessible through a link for as long as the link is valid (currently three days). Anyone passing on a link makes the file accessible. No personal data of third parties and no unlawful content may be shared.
7Updates and usage figures#
The programs check for updates automatically and download them; this is part of the service and also serves security. Selected programs transmit usage figures to winku.de (opens in a new tab) (such as counts of operations, error types, version states). This transmission is part of using the software and cannot be switched off. In addition the programs report anonymous figures (version, operating system, success of updates) that cannot be attributed to any person. Details on which data this is and which data is expressly not transmitted are set out in the privacy policy. Personal data of third parties (such as viewer names) is not transmitted.
8Third-party services#
Some programs work together with third-party services (e.g. Spotify, Twitch, YouTube). These require separate accounts and possibly paid subscriptions with those providers. We accept no responsibility for their availability, terms or content; their terms of use must be observed.
8aVidono — video requests in a stream#
Vidono (vidono.de (opens in a new tab)) connects a Twitch channel with a public page on which viewers can select a clip from a publicly available YouTube video. The channel owner determines what a clip costs, how long it may be and which videos are allowed; the channel owner also decides whether a submitted video is played.
Payments do NOT go through Winku. Payment is made via the method the channel owner has set up themselves (currently their own donation link with a third-party provider). Winku does not receive any money, does not forward any and is not a party to the payment transaction. Claims arising from such a payment exist exclusively against the channel owner and the provider chosen by them.
There is no entitlement to have a submitted video played. The channel owner may reject, skip or block it. Section 5 applies to the submitted content.
Individual Vidono accounts are granted free of charge for operational and testing purposes; there is no entitlement to this.
The display name provided with a submission is shown publicly in the channel's stream. It can be chosen freely; a real name is not required.
8cWinkuBot — bot for Discord servers#
WinkuBot is a bot for Discord servers with a dashboard at bot.winku.de (opens in a new tab). Use is free of charge. You need a Discord account; Discord's terms apply in addition, and you are responsible for complying with them yourself (section 8 applies accordingly).
Anyone who invites the bot to a server and configures it there thereby decides on its use on that server. They are responsible for informing the members of their server about its use, insofar as they are obliged to do so, and for choosing the enabled modules so that they comply with Discord's rules and applicable law. Only those who have the “Manage Server” permission on the server, or a role that the server owner has expressly approved for this, may make changes in the dashboard.
Content created through the bot — tickets, custom commands, welcome texts, embed messages, names in leaderboards — is content of the person who creates it; section 5 applies accordingly. There is no entitlement to particular modules, to their continuation or to a particular level of availability; section 2 applies.
Running your own modified versions, circumventing limits of the service and using the bot for purposes that breach Discord's terms are not permitted. We may block access to the dashboard and remove the bot from a server in the event of a breach.
You can delete your data yourself at any time; how this works and what is removed is set out in the privacy policy. The bot is not an open project: there is no public source code and no image for self-hosting; section 4 paragraph 1 sentence 2 applies accordingly.
8dCueUp — song requests on stream#
CueUp takes song requests from Twitch chat and via channel points and adds them to the streamer's Spotify playback. This requires a Twitch account and a Spotify Premium account; section 8 applies.
Music rights: CueUp does not grant any rights to the music. Whether and which music may be played on stream, in recordings or in clips is governed by the terms of Spotify and Twitch and by copyright law; the streamer alone is responsible for this. The feature that keeps the music out of the recording is a technical aid that requires the correct settings in OBS. We do not warrant that recordings will not be muted, blocked or challenged as a result.
Requests and channel points: viewers have no claim to have a request played; the streamer may reject, skip or block requests. Channel points are refunded via Twitch to the extent Twitch allows; there is no claim to a refund against Winku.
Twitch panel: the panel can be used once Twitch has approved the extension. If the streamer switches the panel on, it publicly shows on their channel what they release for it – optionally including the names and profile pictures of requesters. The streamer decides on this display and keeps it in line with Twitch's rules. What is processed in the process is set out in the privacy policy (section 15f).
8eWovia — availability of films and series#
Wovia shows on which streaming services a film or series is available and keeps lists about them if you wish. Use is free of charge.
No guarantee for the information: title, image and availability data come from third parties (TMDB; TMDB compiles the availability from JustWatch data). Streaming services change their offerings constantly; displayed availability may be outdated, incomplete or wrong, and Wovia does not show prices. Only the offering of the respective service is authoritative. There is no claim against Winku that a title is actually available on a service shown.
No connection with third parties: Wovia is an independent service of Winku. There is no partnership, cooperation or endorsement by JustWatch, TMDB or any of the streaming services shown. Their names and logos are trademarks of their respective owners and are used only to identify their offerings. Wovia uses the TMDB API but is not endorsed or certified by TMDB.
Import from JustWatch: the export script offered is an aid for taking your own data from your JustWatch account with you. You run it yourself in your browser and are responsible for complying with JustWatch's terms of use when doing so. There is no claim that the script works or continues to work; if JustWatch changes its site, it may stop working without notice. Only upload files containing your own data.
Access: Wovia may be restricted to individual accounts, for example while it is being built. There is no entitlement to access; section 2 applies.
8fWatchMod — chat moderation for Twitch#
WatchMod is a bot for moderating Twitch chat, with a dashboard at watchmod.winku.de (opens in a new tab). Use is free of charge. You need a Winku account, a Twitch channel and moderator status for the bot in the channel; Twitch's terms apply in addition, and you are responsible for complying with them yourself (section 8 applies accordingly).
Whoever connects their channel decides on the use in the channel and on the configured rules, texts and actions. They are responsible for ensuring that these comply with Twitch's rules and applicable law, and they inform their viewers about the use insofar as they are obliged to do so. Actions triggered by the bot under these rules or by a person via the dashboard are actions of the channel. Automatic replies and protective measures such as thank-you messages, shoutouts or the raid and spam protection, which temporarily changes chat modes, are likewise actions of the channel; they act according to the channel's settings. Filters decide on the basis of patterns and can be wrong; there is no claim against Winku that every action is correct; otherwise section 9 applies.
Whoever adds people to the team determines their permissions; settings and team remain reserved to the channel owner. The channel owner runs giveaways on their own responsibility; Winku is not the organiser and does not provide prizes. Whoever switches on the public command list makes its content — commands, replies and, if allowed, quotes — available to anyone and is responsible for it.
There is no entitlement to particular features, to their continuation or to a particular level of availability; section 2 applies. WatchMod may be restricted to individual accounts; there is no entitlement to access.
8kBergo — backups for PCs, NAS and mobile devices#
Bergo (bergo.winku.de (opens in a new tab), the program for Windows and macOS, the Bergo station and the Bergo app for Android and iOS) backs up data from your devices to targets you choose yourself – such as your NAS, another PC, a network share, a drive or your storage with a cloud provider –, accepts uploads from mobile devices and archives data to storage media. Use is free of charge; clause 2 applies.
The Bergo app backs up your phone’s photos, videos and, if you turn it on, other files and your contacts over your home Wi-Fi directly to the device you choose for it, or directly to your cloud; they do not pass through our servers. With “Free up space” you delete backed-up photos and videos from your phone after you have confirmed; check on your station or in your cloud beforehand that the backup is complete – as with archiving, you carry out the deletion yourself. The terms of Google Play or the Apple App Store also apply to obtaining the app; on the App Store, Apple’s standard licence agreement for apps applies as well.
Bergo is a tool. The backups are stored on your own devices and storage media; we have no access to them and keep no copy. You are responsible for choosing targets, retention and the credentials for uploads. You operate the Bergo station on your own hardware and decide which folders and media it uses. If you back up other people’s data, such as contacts or photos, you are responsible for being allowed to store it that way.
Backing up to your cloud: you can also choose your own storage with Google Drive, OneDrive, Dropbox, MEGA, pCloud, Box, S3-compatible storage or a provider with WebDAV access (such as Nextcloud) as the target; you don’t need a Winku account for this. You do need your own account with that provider. Your contract with the provider, its terms, prices and storage limits apply only between you and the provider; follow its terms, including what you may store there. Bergo transfers the files straight from your device to the provider. Credentials you enter in Bergo yourself (MEGA, S3, WebDAV) are stored by Bergo on your device only; keep them secret and, where possible, use access with as few permissions as possible. We are not a party to your contract with the provider and have no influence on whether it is available, how much space you have there, whether it suspends your account or deletes files, or whether it changes its interfaces or terms. Some providers (currently MEGA) do not issue their own approval for third-party apps; there Bergo uses the same public interface as the provider’s own apps. If your storage is full, your sign-in has expired or the provider has a problem, Bergo stops backing up there and tells you – keep an eye on these messages. If a provider changes its interface or stops working with Bergo, Bergo may no longer support that provider for a while or for good; there is no claim to support for any particular provider. What you have already backed up stays with your provider as ordinary files, even if you disconnect the cloud in Bergo or stop using Bergo. Clause 9 applies to liability.
Trademarks: Google Drive is a trademark of Google LLC; use of this trademark is subject to Google Permissions. Microsoft and OneDrive are trademarks of the Microsoft group of companies. Dropbox is a trademark of Dropbox, Inc., MEGA a trademark of Mega Limited, pCloud a trademark of pCloud AG, Box a trademark of Box, Inc., Nextcloud a registered trademark of Nextcloud GmbH; Amazon S3 is a trademark of Amazon.com (opens in a new tab), Inc. or its affiliates. Other names Bergo offers as presets (such as MagentaCloud, GMX, WEB.DE (opens in a new tab), HiDrive, Backblaze B2, Wasabi or Cloudflare R2) also belong to their respective owners. Bergo shows these names and logos only to identify the service it connects to at your request. Bergo is not a product of these companies; they have neither reviewed nor endorsed it, and there is no partnership with them.
Bergo backs up what it can read and transfer at that moment. Files that are in use, folders it cannot access, a full or switched-off target, no home network, or your operating system’s limits for apps in the background can mean that single files or whole runs are missing. Bergo shows this in the history and in notifications – keep an eye on them.
What a proper backup within the meaning of clause 9 means for Bergo: you regularly check that your backups are complete and can be restored, and you back up data that matters to you in a second, independent place as well – for example on a drive you keep separately. A single backup does not protect against every loss, for example a hardware failure, theft, fire or malware that also reaches the target. Otherwise, clause 9 applies to liability.
When archiving, Bergo can, at your request, delete files on the PC and/or in a backup after their copy on the archive medium has been verified. You carry out this deletion yourself; keep archive media safe. Every device you connect to your Winku account can access the account’s backups – only connect your own devices and remove devices you no longer use.
bergo.winku.de (opens in a new tab) only makes sure your devices can find each other. If it cannot be reached, new devices cannot be connected and backups may not run. What is already backed up stays readable on your devices as ordinary folders and files, even without Bergo. If we decide to discontinue Bergo, we will announce it on winku.de (opens in a new tab) at least three months in advance.
Passing access to third parties and attempts to circumvent the limits of the service are not permitted. We may block use if this is violated. Bergo may be restricted to individual accounts; there is no claim to access.
8lWink — ScamRadar, Wink Arcade, Wink Plaza and Wink Plus#
Wink (until 25 September 2026 “Spawn”, the mod “ScamRadar”, the games “SMP Arcade”, the subscription “Spawn Plus”) is an independent offering of Winku for players of HugoSMP.net (opens in a new tab); it is not affiliated with the operators of HugoSMP.net (opens in a new tab), with Mojang or with Microsoft. The rules of HugoSMP.net (opens in a new tab) apply in addition; we are not responsible for decisions of the server.
Reporting: Only report what you experienced yourself, describe it truthfully and only send the mod's evidence if it shows the incident. From the mod you can only report on HugoSMP.net (opens in a new tab), and you can only report players who have been seen there. False or deliberately misleading reports, reports out of revenge, arranged reports, mass reports and reports on behalf of others are not allowed; we may reject such reports and bar you from reporting — first for a limited time, and permanently if the abuse continues. If you report an unusually large number of different players in a short time, we do not accept the report and pause reporting for 24 hours; the moderation team looks at it and can lift or extend the pause. The same applies to Wink Arcade and to good experiences. There is no fixed daily limit; how many reports you have available depends on how many of your reports were rejected. If you report an unknown person, you put down a deposit from your Arcade balance (currently $10,000; the mod shows the amount before you send, team members pay none). It is frozen from your balance when you report and is not available to you until the decision. The team decides, with a reason, whether you get the deposit back when it assigns the report to a person or rejects it: if you clearly had direct contact with the person (for example they were on your “Nearby” list, you traded, chatted or talked alone with them) or you keep picking “unknown” although the name was visible, we keep it — you could have named them yourself. If you misuse reports of unknown persons (for example with many such reports, none of which can be assigned), we can also keep the deposit when rejecting the report. If lots of people were around at once or the person couldn’t be recognised, you get it back; when in doubt, it goes back to you. If the case is still unresolved after 30 days or you withdraw the report within the first hour, you get it back in full. How many such reports you can have open at once and send per day is limited.
Warning levels and decisions: Notices and warnings arise automatically from several independent reports and are marked as unchecked; the team sets a strong warning after checking evidence, or it arises when very many players independently report the same thing with evidence, and then stays marked as unchecked. The team decides how serious a confirmed case is; a minor case stays a notice, a moderate one a warning at most. The number next to a name is a risk value: it shows how careful you should be with this player, not whether the accusations are true — that is shown by the note whether the team has checked. The team decides on appeals after its own review; there is no right to have a player put on or taken off the warning list. A warning describes gameplay that others want to be warned about — not a rule violation and not a finding of fact; it expires after the period stated in the privacy policy (Section 15o). Anyone listed can appeal.
Use of the list: The warning list serves solely to protect against scams, traps, griefing, insults and other violations in the game. You may not publish or pass on its contents, including the list of incidents and the team's summaries, nor use them to expose, threaten or harass players.
Second chance: Once we switch the second chance on for everyone, the following applies: anyone with a checked warning can voluntarily disclose the incident and give their side. The team reviews every disclosure before it becomes visible and can decline it without further reasons or remove it at any time, for example if it insults, exposes other players or reveals who reported. The statement must not contain names of other players, links or contact details. Only players who meet the requirements (including account age, a linked Minecraft account, activity, no warning of their own, no false reports, no connection to the warned player) and who have demonstrably looked at the disclosure can vote. Anyone frequently in contact with the warned player or a reporter can vote, but their vote does not count (as far as the mod tracks this). Each account has one vote. How many votes a vote needs depends on the number of eligible players and is shown on the page. Using several accounts, coordinating votes or offering anything for votes breaks these terms; the team can strike such votes and block the account. The result of the vote is a recommendation to the team, not an entitlement. The team decides whether and how far a warning goes down. Only for minor incidents can a clear majority end the minimum level automatically, if the team has switched this on and the mod tracks who is frequently in contact with whom. “Not forgiven” does not change the warning. You can ask for a second chance 14 days after the warning at the earliest, counted from when the incident was confirmed. After “not forgiven” or withdrawing during voting, a new attempt is only possible after 30 days, and later with each further rejection in a row (60, 120, at most 180 days). If the team confirms a new incident within a year of a forgiveness, the lowering no longer applies, the new incident weighs more, and a new second chance is only possible after 180 days.
Account via Minecraft: A Winku account created with "Continue with Minecraft" when linking the mod is tied to your Minecraft account: whoever uses that Minecraft account can sign in with it. So do not share your Minecraft account. If you lose access to your Minecraft account, your confirmed email address gets you back into your Winku account.
Wink Arcade: Stakes, balances and winnings are HugoSMP.net (opens in a new tab) in-game money; they have no monetary value, and we do not exchange them for real money. Only games decided by skill are offered. Which games are available right now is shown in the Arcade; we can switch games on and off at any time — games already running are played to the end. At the start of a game we deduct the stake from every player's balance; the winner receives all stakes, and in case of a draw or cancellation everyone gets their stake back. All players in a game always stake the same amount. You pick your stake (a level or your own amount in whole dollars; you play for money from $10, with 0 you play a friendly game without a stake); if you switch on “Flexible”, you also allow a range. The game is then played for the highest amount that lies in both ranges, not above the higher of the two chosen stakes and not above any player’s balance. Before every start you see the amount, pot, fee and possible winnings; nothing is booked until everyone confirms “Ready”. The amount is never chosen at random. You can answer a challenge with a different amount; that counts as a new challenge. In 2v2 the stake counts per player: whoever invites is the host and picks the game and the stake, but everyone confirms their own stake before anything is charged, and the two winners split the pot equally — whatever does not split into whole dollars stays with the fee. There, a side only loses once both of them have forfeited or stopped sending anything for too long; whoever is left alone keeps playing. In 2v2 fights (Fist Fight, Plank Drop) a team is only out once both are out; a false start or backup by one of you costs the whole team, and there are no hits on your own mate there. The rules of the game as shown in the lobby apply, including the time per move; a lost connection does not stop the clock. In a 1v1 the Wink mods of both players are the referees: by taking part you allow your mod to send the RTP command as well as /tpa, /tpahere and /tpaccept with your opponent's name for the game. Once the RTP has worked, the game is binding: whoever then leaves the arena or the world of the fight — by dying, crossing the edge, teleporting, changing worlds, switching off the mod or being disconnected from the server for more than 30 seconds or until the fight time ends —, forfeits, attacks before the start or brings help into the arena by teleport loses; until the RTP, the game is cancelled without a winner. Before that only one thing applies: after the mod takes over, you must have full health and a hunger bar at most two drumsticks below full and no longer be “in combat” (HugoSMP.net (opens in a new tab)’s indicator) within 40 seconds, and in a fist fight also an empty inventory within 60 seconds (one stack of food may stay; the mod holds it in place) — whoever does not make it or forfeits during that time loses; if neither makes it, the game is cancelled. In the last minutes of a fight the arena may shrink, as stated in the lobby and in the game before it starts; the current edge then applies, and the mod gives anyone the edge moves past a short grace period. If both are still in the arena when the fight time ends, the game ends in a draw (in 2v2 the team with more players in the ring wins; on a tie the stakes go back). Coming back only after the fight time has ended changes nothing. If both sides are disconnected from the server at almost the same time (for example when HugoSMP.net (opens in a new tab) restarts) and neither comes back in time, the game is cancelled and everyone gets their stake back; if the disconnections are further apart, whoever left first loses — in 2v2 the team that was completely gone first. If HugoSMP.net (opens in a new tab) restarts the world of a running fight or the whole server, the fight is cancelled and everyone gets their full stake back. No new fights start until the restart is over. If only one of your mods reported the announcement, this applies only once you both have to leave the world because of it; otherwise the normal rules for leaving apply. If Wink is restarted during a fight, nobody loses because of it: the time limits continue afterwards, and whatever your mod reported during the pause counts with the time it happened. In Plank Drop your figure stays on the deck if you leave the game; if nothing more comes from you for 10 seconds from the start of the first round, you lose. If Wink is restarted during a Plank Drop game, it is cancelled and everyone gets their stake back. From your teleport into the arena the mod locks your commands, the chat and, before the start, server menus (until then you are free); getting around this lock is not allowed. If the teleport after the RTP gets stuck on your side twice within 7 days, fights are paused for you for that time. If the reports of the two mods contradict each other, the stakes are held until the moderation team has decided; if it does not decide within 72 hours, everyone gets their stake back and nobody counts as being in the wrong; whoever was in the wrong twice is excluded from 1v1. Combat helper programs and modified versions of the mod are not allowed; each time you start Minecraft and each time you join HugoSMP.net (opens in a new tab), Wink checks whether your mod is an official, unmodified version; without a passed check 1v1 is locked, and if it is certain that it is not one, Wink also accepts no reports through the mod until you use the original version. The rules of HugoSMP.net (opens in a new tab) on fighting apply in addition. You can only deposit from a Minecraft account linked to your account; we pay back money from accounts that are not linked. The limits stated on the “Bank” page apply to withdrawals; if the bank is closed or paused, withdrawals wait until it is open again. On every withdrawal we keep 3% of the amount as a fee (2% with Plus Gold), rounded down to whole dollars, but at least $1 — so you can withdraw from $2; the bank bot pays you the rest. If a withdrawal does not go through, you get the fee back too. Helper programs, arranged games, games between your own accounts and exploiting bugs are not allowed; in such cases we may cancel games, reverse bookings and exclude you from Wink Arcade. If in-game money is lost because HugoSMP.net (opens in a new tab) bans the bank bot's account or resets its economy, there is no claim to compensation. If we discontinue Wink Arcade, we will announce it in advance; until then you can withdraw your balance. Before you delete your data at Wink, withdraw your balance; a remainder under $2 can no longer be withdrawn and is lost on deletion, and a running Wink Plus ends without a refund.
Fee: If someone wins a game with a stake, 12% of the pot (all stakes together, rounded down to whole dollars) goes to us as a fee, but at least $1; the rest goes to the winner. On a draw and on cancelled games there is no fee — everyone gets their stake back in full. It is lower in two cases: while an event is running for a game — which we set for a limited time when that game is hardly being played, or schedule on purpose — it is 7% in that game. Anyone who searches through “Any game” with at least four games whose range includes the amount played pays one percentage point less as the winner and is matched first. Both together never come to less than 6%. There is no claim to events or reduced rates. How high the fee is is shown before you play, at the stake selection, and after every game in dollars and per cent. The fee, too, is HugoSMP.net (opens in a new tab) in-game money and has no monetary value. We may change it; what applies is always the rate shown when the game started. We pass on 75% of fees and purchases to HugoSMP.net (opens in a new tab); how much of it goes to HugoSMP.net (opens in a new tab), to Wink and, where applicable, to your creator, we show you next to the amount in question.
Tournaments: A tournament is hosted by Winku or by a host Winku has approved. When you sign up, you pay the entry fee into the prize pot. If you leave before the start, if the tournament is cancelled or if too few players sign up, you get it back in full. If you do not show up in time when you are called, you lose that match — unless the tournament is paused. At the end Winku keeps the usual Arcade fee from the pot; the rest goes to places 1 to 3 in the shares shown on the tournament page. Disputes are decided by the team, not by the host. Approved creators can host tournaments. They choose game, time, spots and stake only within limits we set. They have no say over the fee, prize rules or disputes. If the host moves the start, you are notified and can leave before the start with your full stake back. If they start early (“Start now”), it begins right away and you are notified. They can also pause the tournament: running fights finish, then it rests at most 10 minutes at a time and at most 20 minutes per tournament in total (only the team may pause longer for disputes). No deadline runs out during a pause; afterwards you still have at least 30 seconds to answer a call. If they cancel, you get your full stake back.
Creator programme: You become a creator by applying. Anyone who has linked their Minecraft account and a Twitch channel to their account can apply in the bank; we decide at our own discretion, and there is no right to be accepted. After a rejection you can apply again after 14 days. You only get your creator link once you are accepted. The code is always your own Minecraft name, never something made up. If someone enters another person's code — by hand, or by arriving through the link and agreeing there — then for 14 days 2 percentage points of the winner's stake (rounded down to whole dollars) count as that creator's share and are credited to their balance whenever that player wins a game with a stake. If a game's fee is only the minimum fee of $1, none of it goes to a creator. Nothing changes for the player: their winnings are the same as without a code, the share comes out of our fee. If, while the code applies, the player buys in the shop (cosmetics and emotes) or Wink Plus (purchase, renewal and gift, including Plus Gold), we additionally credit the creator with 1.5% of the price paid for shop purchases and 2.5% for Plus purchases, each rounded down to whole dollars; below $1 nothing goes to the creator. The player does not pay anything extra for this either: the price stays the same and the share comes out of our revenue. If the player gifts Plus, their own code counts, not the recipient's. In their ledger the creator only sees the amount and the source (shop or Plus), not who bought something or what. If such a purchase is refunded or the player withdraws from it, we debit the creator's share accordingly, proportionally for a partial refund and at most up to what the creator still has in their balance. Nobody can enter their own code on their own account. You can change or remove a code at any time; it does not renew by itself. We may switch off or revoke individual codes and refuse the creator programme to an account altogether — for instance if someone credits themselves through further accounts of their own, advertises misleadingly or breaks these terms; running shares end with that. What a creator earns is in-game money and is paid out like any other balance — there is no claim to real money.
Drone hangar and referrals: There are 25 radar drones. The next one goes to whoever next clears a test flight (level 1) while the hangar is open — what counts is the order in which our service recomputed and accepted the flights, not what the mod shows. Only a flight that our service can recompute itself and that was not faster than the time it takes counts; there is one drone per Minecraft account. Levels 2 to 5 open once you have cleared the level before; there is no drone on them. We decide when the hangar is open. If someone obtains a drone or a referral reward through helper programs, modified mods, further accounts of their own or advertising in the HugoSMP.net (opens in a new tab) chat, we may revoke it; the number of a revoked drone is not handed out again. Referral rewards (achievements, Discord role, radar antenna, subscription time) exist for as long as we offer them; there is no claim to money or to any particular reward. Crown drone contest: From time to time we run a contest at the hangar. We announce the period at the hangar and on smp.winku.de/cosmetics (opens in a new tab); we may extend it or end it early. Taking part is free and needs nothing but the mod and a linked account. Only cleared flights count that start within the period while you are playing on HugoSMP.net (opens in a new tab) with the mod and that our service has recomputed itself; points are the signals collected. How a contest is scored is set when we set it up: by levels — your best flight on each of levels 1 to 5 counts and the points are added up — or as single-flight scoring, where only your best flight on level 1 counts. Level 1 runs at exactly one difficulty in every contest, and only flights at that difficulty count there; older versions of the mod always fly at “Normal” and therefore only count if the contest runs at “Normal”, and versions without levels only fly level 1. We may change the difficulty as long as no level 1 flight in the contest has been scored yet; after that it stays until the end. Whoever has the most points at the end wins; on a tie, whoever reached that score first (the order in which our service accepted the flights). When the contest ends, the hangar closes for good — no more flights are possible; radar drones already handed out stay. The prize is the crown drone, a cosmetic of which there is exactly one; it belongs to the Minecraft account that flew the winning flight, cannot be transferred and cannot be paid out in money or in-game money. Anyone taking part with helper programs, modified mods or further accounts of their own is excluded; if that comes to light after the award, we may revoke the crown drone — it is then not handed out again.
Donations to creators: Approved creators can switch on a donation link. You can only donate with your Wink balance (HugoSMP in-game money); donations are voluntary and nothing is given in return. We keep 8% of every donation as a fee for winku.de (opens in a new tab), the rest goes to the creator's balance; like arcade winnings, donations can only be withdrawn after 24 hours. A donation is not refunded — unless you send a video along and the creator rejects it, does not approve it within 12 hours or it cannot be played on stream: then you get the full amount back (if the donation had already been credited to the creator, they return their share for it). Whatever you write as a message, the whole stream sees and hears. Insults, hate, advertising and outside links are not allowed; we hide links and slurs, and the creator can block further words and block donors. The creator is responsible for their stream, the alert and the videos they approve or let play — including what the moderators they add to their video queue do. If someone misuses the donation link (for example to move balance to themselves or to harass with messages), we can switch off their donations and their donation link.
Gallery: In the gallery you can sell your own pictures as works, buy pieces by other players and hang them in HugoSMP, where everyone with the Wink mod can see them. You can only pay with your Wink balance (HugoSMP in-game money). Every work is offered for sale to others, in an edition you set when uploading (1 = one of a kind); later it can only go down, when you close the edition, and never up. You can never own your own works — not buy them, not get them second hand, not take them and not take them back, not even through accounts linked to yours. Works that were just for you before this rule are resting until you set edition and price; instead you can delete them and get back the fee you paid back then; a piece of them you held yourself is dropped, and what you had paid for your own pieces is refunded. When uploading you pay a creation fee that grows with size and edition and follows the value of money on HugoSMP; we show it to you beforehand. If we reject the work (also as a duplicate), you get it back except a review share (currently 10%) — the first rejection each month in full. There are no running costs for a work. How many works you can sell at once and submit per week, how large an edition may be and how many pictures can hang at once depends on whether your Wink Plus is running; the limits are shown when uploading and in your collection. If you are over a limit — for example because Plus ends or could not be renewed —, we pause sales of your newest works and move the pictures hung most recently into your collection until there is room again; pieces already sold always stay unchanged with their owners. You may only upload pictures you made yourself and hold the rights to: no one else’s art, no real people, no advertising, links or QR codes, no banned symbols, nothing offensive — the standard is “suitable for everyone”. By uploading you allow us to store and adapt the picture and to show it in the gallery, on smp.winku.de (opens in a new tab) and in the mod. The painter sets the price; a purchase is a deal between players, not with Winku. On the first sale of a piece the painter gets 90%, on every resale the seller gets 70% and the painter 20%; we keep 10% each time (at least $1). You can withdraw proceeds 24 hours after they are booked. From the painter, accounts that are linked to each other can together buy only part of an edition (currently 20%, at least one piece); numbers are given out in order, never drawn by lot. So that nobody plays tricks through friends or further accounts, accounts count as linked if one has the other on their friends list or a friend request is open, if both traded from the same network within the last 30 days, if the same Minecraft account showed up on both, or if one gifted Wink Plus to the other. Between linked accounts there is no purchase, no resale and no taking, and accounts linked to the painter can neither buy nor take their works. A piece does not go back within 30 days to someone who sold it; bought pieces cannot be taken for 72 hours, taken pieces cannot be sold for 7 days, and you can offer a piece you bought again 24 hours after buying it at the earliest. Anyone who linked their Minecraft account less than three days ago cannot take or offer anything and can buy at most one piece a day from painters; anyone who is frozen or banned in Wink Arcade cannot buy or offer anything in the gallery. The team reviews unusual purchases (for example far below market value or again and again between the same accounts). Anyone who stays at a hanging picture for a few seconds can take it — this is part of the game and not an offence, and there is no replacement or return for it; in your collection a picture is safe. The team decides about reported pictures. For violations we can block pictures and ban you from the gallery; while you are banned, sales of your works are paused too. If a work is blocked, the image is no longer shown, and whoever has a piece of it keeps it but can neither hang nor sell it; there is no refund for this, neither from us nor from the painter. For illegal content we delete the file.
Played by hand: You play the browser games with a stake and the small games with a leaderboard yourself, with a mouse, finger, pen or keyboard. Scripts, macros, auto-clickers, remote-controlled browsers and any other helper that moves, clicks, types or remembers for you are not allowed there. Reporting a score you did not play is no longer possible anyway: in the small games we replay your run from your inputs ourselves, and our number is the one that counts (see the privacy policy). You only get a mark if we can prove something — more game world than time has passed, an input from outside your run, an inhumanly fast reaction. Anything that merely stands out is looked at by a person; nothing happens automatically because of it. Only after the third mark do your runs in the small games stop counting towards the leaderboards, and after two proofs you can no longer start games with a stake. You can keep playing, friendly games without a stake remain open to you, and you can have this reviewed by support. In the fighting modes on HugoSMP.net (opens in a new tab) the rules of HugoSMP.net (opens in a new tab) also apply.
Emote Guess: You name 15 emotes; one guess counts per picture. Points are given for being right, for small typos and for speed from the moment the picture appears for you. If one player can no longer catch up, the game ends at once. Pasting is blocked. Tools that recognise pictures or type names for you are forbidden and count as cheating under this section.
Reports, freezing and no compensation: Anyone who played in an Wink Arcade game can report it up to 48 hours after it ended; the recording of the game comes along. If two different players report the same account from games with a stake, we freeze it until the moderation team has decided: until then that account gets no games with a stake and no withdrawals; friendly games remain. You can stake Wink Arcade winnings again right away, but withdraw them only 24 hours after the game; the same applies to creator shares, donations, compensation and proceeds from the gallery, each 24 hours after it is booked. Winnings from a game that was reported against you can only be withdrawn once the moderation team has decided on the report. You only play games that run over a direct connection (such as Jelly Volley) with a connection that is fast enough (ping up to 150 ms) — otherwise the game is cancelled and the stakes go back; whoever sends nothing for more than 12 seconds during the game loses. If the team finds that someone cheated (script, hack, deliberate lag, collusion, exploited bug), we lock games with a stake for that account and use its Arcade balance as follows: from it, the players who lost a game with a stake against that account in the 14 days before get their stake back pro rata, as far as the balance reaches; we pay the rest back to the linked Minecraft account free of fees, rounded down to whole dollars. If no account is linked, the rest stays reserved until one is. Beyond that there is no claim to reimbursement of lost stakes or fees — neither against us nor against others — and we do not add anything from our own funds. Whoever reports games that turn out to be unfounded can no longer report in Wink Arcade after three rejected reports. The team can also dismiss a report that is not confirmed without any consequences for you; only what the team classes as a false report counts as rejected. The team can also bar you from reporting in Wink Arcade for a limited time or permanently.
Play fair in the Wink Arcade: leaving Wink Arcade games (giving up, disconnecting without returning within 90 seconds, leaving a fight or not showing up after “Ready”) raises your level. The consequences are currently: a warning, then 5 minutes, 15 minutes, 1 hour, 6 hours and after that 24 hours without games against others; it is never more than seven days. Every day without leaving lowers the level by one. Cancellations caused by restarts or outages do not count. The game you left is settled as before; there is no right to have a lock lifted, but the team can lift it in individual cases.
Subscriptions and Wink Plus: Wink Plus is the only subscription. It costs a daily price in HugoSMP.net (opens in a new tab) in-game money; which terms there are and what they cost is shown on smp.winku.de/plus (opens in a new tab) and in the mod’s Plus window. We offer discounts for longer terms and in promotions; only the highest matching discount applies, discounts are never combined, and a promotion only applies to purchases within its period. The price is taken from your balance right away. Buying again adds the time at the end, at most 60 days ahead. What Plus includes and what everyone has without it is shown on smp.winku.de/plus (opens in a new tab). Plus gives no advantage in matches, title games, leaderboards, at the drone hangar, when reporting, in the bank or when trading. Plus effects are off in matches. Starting the handshake needs Wink Plus; anyone with the mod can shake on it. Features marked “coming soon” or as a preview give no claim that they will exist or stay. Early access: with Wink Plus you can use selected new games, events and features as a Plus beta before they are released to everyone; what is currently included is listed at smp.winku.de/plus (opens in a new tab). We decide whether and how long something runs as a Plus beta; there is no entitlement to specific content or time periods. Plus betas do not count towards achievements, leaderboards or events, and protection features (warnings, reports, evidence) are never part of it. Picks from the shop: Once the shop is unlocked for you, with Wink Plus you can also pick from the shop. Cosmetics: You have three slots. Into each you put a cosmetic that can be bought in the shop and that you do not have on any of your Minecraft accounts; it is then equipped for 7 days, locked in (each slot counts on its own), after which you can fill the slot again or empty it. It is worn on all your Minecraft accounts linked to Wink, in the default way of wearing it. Emotes: You have six slots. With your first Wink Plus we put six random emotes from the shop that you do not have into them; you can swap them straight away, one by one or all. An emote you choose yourself then stays locked in its slot for 4 days, after which you can swap it again. The picks are only on loan: they do not belong to you, they only apply while Wink Plus is running, and you have no claim to particular cosmetics or emotes — what is in the shop and thus available to pick is up to us. If you buy a cosmetic or emote that is in your picks, its slot becomes free; what you buy stays yours (see “Cosmetics and emotes shop”). When Wink Plus ends, the picks from the shop rest and come back with Wink Plus — without a new random draw and without a new lock. These picks apply instead of “all emotes with Wink Plus”: you then only play emotes from the shop if they are in your picks or you bought them; emotes that are free for everyone and the handshake stay as they are. Until the shop is unlocked for you, what smp.winku.de/plus (opens in a new tab) says applies. Former single subscriptions run until the end of the paid time and do not renew. You can gift Plus only while your own Plus is running. Plus days from “invite friends” are gifted time: per friend who counts 1, 2, 3, 4, then 5 days each, at most 60 days ahead. A trial exists only through a voucher, never automatically. Plus Gold: on top of a running Wink Plus you can book Plus Gold, at most 28 days ahead; it costs the price per term shown on smp.winku.de/plus (opens in a new tab), and price changes, discounts, discount codes and automatic renewal work the same as for Wink Plus. While Plus Gold and Plus run, you pay a 2% instead of 3% fee when withdrawing (at least $1), and if you win a 1v1 in the Wink Arcade your fee is 2 percentage points lower, never below the minimum fee. Savings are capped at $150,000 per 7 days; above that the normal fee applies to the whole match or withdrawal. A creator’s share, stakes, pot and gameplay stay unchanged, 2v2 uses the normal rate, and Plus Gold gives no advantage in matches. While Plus Gold runs, we show your Plus mark in gold. When Plus ends, Plus Gold has no effect; there is no refund for the remaining time. “Renew automatically” is off until you switch it on. If it is on, we charge the price valid at that time at the end of the term. If your next renewal would cost more (including because a discount ends), we notify you right away with the new price and the day from which it applies, which is at least three days after the notice. Until then you can choose “Not at the new price”; the subscription then no longer renews and ends with the paid time, without refund or reduction. If you choose nothing, the new price applies from that day; if the subscription renews before that day, the previous price still applies. Price reductions apply immediately. What you have already paid is never charged again afterwards; new purchases pay the price valid at the time of purchase. If your balance is not enough for that, the subscription ends and the features are locked again — we do not send reminders, do not book anything into the negative and do not claim anything afterwards. You can switch off “renew” at any time; the subscription then runs until the end of the time you paid for. When a subscription ends, the Plus badge, name colour, profile design and frames are no longer shown; your choices are kept, and whatever you earned stays yours. You can gift Wink Plus to another player with a Wink account: you pay, they get the days at no cost and without renewal; a gift cannot be transferred or returned, and we refund nothing for it. A Wink Plus trial through a voucher is available once per account and only if you have not had Plus before. We issue discount codes at our discretion, for example in promotions or through creators. A code only applies when buying Wink Plus or Plus Gold on smp.winku.de/plus (opens in a new tab) or in the mod, only to that one purchase and only under the stated conditions (subscription, term, period, number of uses). It gives either a percentage off the full price of the term or free days on top of the term you buy. A code is never combined with another discount: whichever is cheaper per day applies; if the term discount is cheaper, the code is not used up. An automatic renewal afterwards costs the normal price. Codes and free days have no cash value, are not paid out or refunded and cannot be transferred; free days are not counted in a pro-rata refund. We may end codes at any time; benefits already redeemed stay. Misuse (for example reselling or automated guessing) can lead to exclusion from the code. As in-game money has no monetary value, we do not refund periods already paid for and pay nothing back in real money. Exception: if the moderation team ends a subscription early (for example after an error or in case of abuse), it can book the unused part back to your in-game balance pro rata — at most what you paid for this subscription; it can also extend a subscription at no cost to you. Either way you get a notice. Risk-free refund (offer): We may also run an offer for a limited time during which you can take back a purchase of Wink Plus or Plus Gold. While it runs, we show on smp.winku.de/plus (opens in a new tab) how long it lasts and how much time you have after buying (at most 24 hours); after buying we tell you your deadline. It applies to purchases you make during the offer, including buying more time and automatic renewals — not to gifted Plus and not to other purchases. If you take back a purchase on smp.winku.de/plus (opens in a new tab) or in the mod’s Plus window within that window, the time you bought, including free days from a discount code, ends right away, “Renew automatically” is switched off and we credit the amount you paid to your balance; it is not paid out. If the purchase has already brought you money by then (photo booth photos that were free with Plus, at the photo price that applies then, or fees saved with Plus Gold), we deduct that; if nothing is left, no refund is possible. A discount code you used stays used. During an offer you can take back each subscription at most once. The window belongs to the purchase: if the offer ends early, you can still take back purchases made during it until their window closes. If the team has already ended or refunded the subscription, a refund is no longer possible. The offer is voluntary; there is no right to have it offered. Your statutory rights remain unaffected. We can make a feature free for everyone again at any time, or dissolve a package — running subscriptions for it then end and are no longer charged — and change the price or term for future periods. Reporting, the warning list, warnings, protection against TPA traps, the evidence including its length and where warnings appear on screen always stay free.
Emotes in chat: The Wink mod shows the 7TV emotes of the channels we pick (currently LetsHugoTV) and emotes from Wink itself in chat. The 7TV emotes belong to their creators; these channels decide on 7TV which ones there are, and we only display them; we can change which channels we include at any time. Some emotes are Wink Plus only: without Plus you can look at them but not insert them. The team can hide single ones here. With Wink Plus you can upload up to five custom emotes that everyone with the mod sees in your chat lines. Only upload pictures you made yourself or may use freely — no emotes of other streamers or artists, no real people, nothing offensive, no hate and no banned symbols, no advertising, links or QR codes and nothing that looks like a ScamRadar warning mark, a rank or a staff sign. The name must not insult or mislead anyone and must not sound like a command, the team or ScamRadar. The team checks every custom emote before anyone sees it; it can reject emotes, block approved ones again and ban you from custom emotes for violations. There is no claim to approval. You allow us to store your emotes for Wink, convert them and show them to all players with the mod and on smp.winku.de (opens in a new tab) for as long as they are with us. Emotes are only for looks: they give no edge in the game and never appear in warnings, TPA, payment or trade lines. When Plus ends, your custom emotes are paused; after 365 days without Plus we delete them. If an emote from 7TV or Wink with the same name is added to chat, it takes precedence and yours is paused until you rename it. We can change the number of slots for future periods and switch emotes off entirely or for single players; we refund nothing for rejected, blocked or paused emotes.
Vouchers: The team can hand out codes that give a subscription to a feature or a package (such as a 7-day Wink Plus trial), a cosmetic or — only with approval from the HugoSMP.net (opens in a new tab) server management — in-game balance, on their own or together. If a code with balance cannot be redeemed right now, it stays unused. Each account can redeem a code only once; a code can be limited to a number of redemptions and can expire, and we can withdraw it — anything already redeemed stays. A subscription from a voucher costs nothing and does not renew by itself; Plus Gold from a voucher can only be redeemed while your Wink Plus is running (otherwise the code stays unused), it only works while Plus is running, its days keep counting down even without Plus, and it is not refunded; a cosmetic requires a linked Minecraft account. Balance from a voucher is in-game money like any other Wink Arcade balance and has no monetary value.
Points for ideas and bugs: The team awards points for ideas that get built and bugs that get fixed at its own discretion; there is no right to have something built or to a certain number of points. Points have no monetary value, cannot be transferred and can only be swapped for days of Wink Plus (the offers are shown on smp.winku.de/ideas (opens in a new tab)); swapped days do not renew by themselves and are not refunded. If the team changes a decision, we adjust the points, downwards too. Points expire with the account.
Cosmetics and emotes shop: Once the shop is unlocked for you (on smp.winku.de/shop (opens in a new tab) and in the cosmetics window of the Wink mod), you can buy cosmetics and emotes there (emotes are the animations of your character that are not free for everyone anyway). You only pay with your HugoSMP.net (opens in a new tab) in-game balance, never with real money; the price shown on the item when you buy applies. You buy a cosmetic for one of your linked Minecraft accounts — it belongs to that account. You buy an emote for your Winku account — it is yours on all your Minecraft accounts linked to Wink. You can buy several items together in one cart. That is one purchase: it all works or nothing does; if your balance does not cover everything, nothing is booked. Purchased cosmetics and emotes cannot be transferred and are not refunded or taken back. Your statutory rights remain unaffected. We decide which cosmetics and emotes are in the shop and at what price; limited, numbered and event items are not sold there. Items from partners (e.g. PEEPO by peepoPlush) are used with permission; if a partnership ends, they may be adjusted or removed. For partner items we link to the partner’s website and show a creator code for a discount. These links are advertising and are marked “Ad”. If you buy from the partner through such a link, we receive a commission; it costs you nothing extra. Your purchase from the partner is subject to the partner’s own terms. If we take something out of the shop or change its price, you keep what you already bought. We may reduce the price of cosmetics and emotes for a limited time (a discount, possibly with an end date). A discount only applies during the period shown, and the price shown on the item when you buy applies. If you bought earlier at the normal price, we do not refund the difference. Instead of buying an emote, you can swap it in for a slot of your picks with Wink Plus (see “Subscriptions and Wink Plus”, picks from the shop); if you buy a cosmetic or emote that is in your picks, its slot becomes free. A cosmetic you buy is put on straight away. Items that cover each other cannot be worn at the same time: then the one you wore before is taken off; if you buy two such items together, one of them stays off. Everyone with the Wink mod can see your item; you decide yourself whether it is shown. Everyone with the Wink mod sees an emote when you play it.
Perks for server boosters: If you boost our Discord server and your Discord is linked to Wink, you get the booster cosmetics and the pink booster paints, and with Wink Plus also the pink chat colours — as a voluntary extra you have no claim to. They only apply while your boost runs and three more days; after that they rest until you boost again — nothing is deleted. We can change or end the perks for boosters at any time. You buy the boost itself from Discord; we get no money for it, and there are no Plus days or balance for it.
Your own pictures for cosmetics: You may only upload pictures you made yourself or may use freely, and you confirm this when uploading. Not allowed are offensive or not-safe-for-work content, hate, banned symbols and insults, real people without their permission, other people’s art or brands without permission, advertising, links and QR codes, and anything that looks like a ScamRadar mark, a rank or staff. You can upload at most 5 own pictures in 7 days (rejected ones count too), only as PNG of up to 256 KB in the size of the template. By uploading you grant us the right to store the picture, crop it and rewrite it without metadata, review it and, once approved, show it on your character to everyone with the Wink mod and on smp.winku.de (opens in a new tab) — for the clan banner on the members of your clan — and, as long as you allow adopting, also on the characters of those who adopted your design. There is no right to approval. The team can reject or block pictures — a block applies to every identical picture — and block you from uploading for a while or until further notice; you can appeal once against a block, and someone other than the person who blocked decides. An adopted design remains its creator’s picture: if they delete it, stop allowing adoption or it gets blocked, you wear the default design again.
Sounds for Copycat: You may only submit sounds you recorded yourself or may use freely, and you confirm this when submitting. Not allowed are music and clips from films, shows, streams or other people’s videos without permission, voices and recordings of people who did not agree, offensive or not-safe-for-work content, insults, hate and illegal content, advertising, and sounds that are overly loud, shrill or distorted; the same applies to the title and the preview image. You can currently submit at most 3 sounds in 24 hours (rejected and withdrawn ones count too) and have at most 5 in review at the same time; with a ScamRadar warning of level 2 or higher you cannot submit. By submitting, you grant us free of charge the simple, non-transferable right to store, trim, level the volume of, convert and review the sound, title and image and, once accepted, to play or show them in Copycat to all players of a round and to signed-in visitors on smp.winku.de (opens in a new tab), together with your Minecraft name. This right ends when you withdraw the submission, the team deletes the sound or your account is deleted; we then no longer play it. There is no right to acceptance. The team can reject sounds, switch them off or delete them later, and block you from submitting for a while or until further notice. If a sound is reported several times, we take it out of the game for now until the team decides. If a sound infringes the rights of others, you indemnify us against claims third parties assert against us because of it, insofar as you are responsible for the infringement. Misusing the report function (for example deliberately false reports) is not allowed.
Show on laptop: You may only show pictures you have the necessary rights to or that may be freely used. Not allowed: offensive or not-safe-for-work pictures, hate and banned symbols, scams and dangerous links, advertising and spam, other people’s work without permission, and people without permission or personal data. By showing a picture you grant us a simple, free right to copy it, shrink and re-encode it for this display, store it (until the deletion period) and show it to nearby players. We are not responsible for the site behind the link. We may block pictures, links and domains and withdraw the feature from you; you will be told the reason and can contact support.
Lounge cinema and photo booth: A video you wish for in the lounge cinema is seen by everyone with the Wink mod near that lounge and heard by those inside; a photo booth photo you release is seen by everyone with the mod on the sign next to the photo booth. Clause 5 applies to both. You can remove your own video wish again, and the team can remove any wish. Photos can be reported — if three people report the same photo, we take it off the sign right away — and the team can ban you from the photo booth. The lounge cinema plays videos in YouTube’s embedded player, which your mod starts on your PC once you have turned it on on the screen; YouTube’s Terms of Service (youtube.com/t/terms (opens in a new tab)) also apply. Only videos whose channel allows embedding play; live streams and videos longer than 60 minutes do not work, and we do not download any video.
Photo booth: a photo in the photo booth costs in-game balance; the booth shows the current price before every shot. With an active Wink Plus, up to 50 photos per calendar day are included; every further photo costs the normal price. When you press the button we only reserve the price; we charge it once the photo is stored with us. If the shot or the upload fails, you pay nothing, and no photo is charged twice. If your balance is not enough, there is no photo. If our team deletes a photo you paid for, you get the price back automatically. There is no refund if you delete a photo yourself, if it is deleted when its period ends (30 days, 365 days with Wink Plus), if it is only taken off the display stand, or if you delete your account. The ‘LetsHugoTV’ figure in the photo booth shows the likeness of streamer LetsHugoTV with his explicit permission. The photo with him costs a surcharge in in-game balance; no real money is involved.
Escrow trading: The escrow secures trades between players with in-game money from your Wink balance. We are not a payment service; real money is never involved. When the buyer confirms, we freeze the price. The seller receives it when both players’ mods confirm the handover of exactly the items bought, when the buyer confirms receipt, or when a one-sided handover draws no objection within 24 hours. If no handover happens, the full price goes back. With “Safe handover”, after both players agree, the mod sends /rtp, /tpahere, /tpaccept (only for the trading partner) and /spawn. The money is only released once the buyer’s mod still finds the items at spawn; if anything is missing there, the team decides. The mod only prevents your own hits and dropping the bought items in your own game. The fee is 10% of the price (rounded down to whole dollars, at least $1), paid by the seller; the rate shown before confirming applies. Proceeds can be used in Wink right away and withdrawn after 24 hours. Deadlines: offer 3 minutes, handover 10 minutes, objection 24 hours, review up to 24 hours after completion. In a dispute the team decides based on both mods’ replays and reports; after a review it may book back proceeds as far as they are still available. Two false claims within 180 days suspend escrow trading for 30 days. Players hand items to each other themselves; we have no access to items and are not liable for them, only for the frozen balance under these rules. No escrow trades with players at warning level 2 or higher. We may switch the escrow off at any time; running trades end under these rules. The rules of HugoSMP.net (opens in a new tab) continue to apply.
Chat House: In the Chat House you meet other players at random. Be respectful and don’t share anything private. The mod brings you together with /rtp and /tpa; HugoSMP.net (opens in a new tab)’s rules apply. The house is only shown in your game: your character stands in the wild, where HugoSMP.net (opens in a new tab)’s PvP and mobs apply. Wink is not liable for losses there; section 9 applies. Anyone who harasses, scams or asks for private details can be reported and excluded. With the camera you show yourself (no black screen, no photo, no someone else’s video). Nudity and sexual content, violence and weapons, filming others without consent and recording what the other person shows are not allowed. Breaking this can get your camera banned.
Wink Karaoke: You sing yourself and are responsible for what you sing. Taking part requires Simple Voice Chat. Tips to singers are voluntary; we keep the same fee as for Wink Arcade games (currently 12%, at least $1), and like winnings the singer can only withdraw the rest after 24 hours. A tomato costs the price shown, taken from your Wink balance; it goes to us and is not refunded, even if the song ends or is skipped afterwards. A song request costs the price shown, taken from your Wink balance (it goes to us), or your free request of the day with Wink Plus; if nobody sings it, it gets skipped or can no longer come up, you get the amount or the free request back. With the “Money Flex” emote you throw real balance: the amount you enter is deducted, goes to us and is not refunded. How many tomatoes you can throw is limited. Anyone who is booed off can't take part for a while; there is no right to a turn, and anyone who disrupts or harasses others can be reported and excluded.
Wink Messenger: No harassment, no advertising and no spam, and don't forward other people's private messages without their consent. The team can block the messenger for you for a limited time or permanently. There is no right to have a message delivered; messages that are not fetched within 30 days expire.
Mod: The mod is only active on HugoSMP.net (opens in a new tab). Outside Wink Arcade fights it never accepts TPA requests by itself; you decide whether to accept one — if you pull in the participants as the host of a tournament, it accepts only their requests on your click, one per second and none from players with a warning; with “Safe handover” in escrow trading it accepts, once you both agree, only your trading partner’s request, and in the Chat House as host only the other person’s; in Wink Karaoke it sends your request itself when you switch lobbies and, while you take part, accepts only the request of another participant who switches into your lobby — it hides the related lines for both of you. In a 1v1 and a fist fight (also in 2v2) the mod sends the commands named there by itself, locks your other commands and the chat for the duration of the fight and accepts only the requests of your opponents and team mates. You switch on the chat cleaner yourself; whether it is allowed on HugoSMP.net (opens in a new tab) depends on the server's rules, and you are responsible for that. For the mapart shop the mod only sends /ah with the mapart’s name and highlights the buttons; you buy every part yourself with a click. On HugoSMP.net (opens in a new tab) (Minecraft 1.21.6 and later) the mod switches TPA requests, payments or the ender chest in /settings only for the duration of a fight, a tournament, the Chat House, Wink Karaoke, a safe handover, a deal, a payout or the bank bot viewing your ender chest, and then back exactly as they were; you can turn this off under Options → TPA, and it then asks in chat. It only accepts or declines HugoSMP.net (opens in a new tab) friend requests on your click. With the money handshake (deal) the mod only sends /pay after you clicked the button with the amount in the window and someone shook on it. Whether the payment goes through is up to HugoSMP.net (opens in a new tab); we do not book any money and are not liable for in-game payments. The mod is free of charge and provided without warranty; Clause 9 applies.
Mod bans: We may ban you from using the Wink mod for a limited time or permanently, and if needed also from using the website, if you break these terms or the rules or misuse the mod. You see the duration and, if we give one, the reason in the mod and in your account. Your account, your data export, deleting your account and the legal texts always stay available. If we ban you permanently from the website too, we pay your balance to your linked Minecraft account free of fees; without a linked account it stays reserved until one is linked. You can appeal via winku.de/support (opens in a new tab).
Hide and Seek passes: Once we have opened sales, you can buy Seeker Passes and Hider Passes – only in the game on the Hide and Seek server (in the pre-lobby, “Passes” menu, with a confirmation), not on the website. You only pay with your HugoSMP.net (opens in a new tab) in-game balance, never with real money; the price shown when you buy applies. A pass is not a subscription but is good for a single use: passes are kept as a count in your Winku account until you use them and never expire; you can only use them in the game with a linked Minecraft account. Before a round you switch a pass on, only one at a time; it counts for exactly the next round you play, and after that it is off. A Seeker Pass makes you a seeker at the start of the round; if more players have a Seeker Pass on than there are seekers, it is drawn among them. A Hider Pass leaves you out of the seeker draw; if everyone in the round has one on, the draw is normal. Exactly one pass is used up, and only if it worked; anyone with a Seeker Pass who was not drawn keeps it. You only get a used pass back if the round is cancelled before the seekers are let out. A pass only decides your role at the start: anyone who is found becomes a seeker as usual. Purchased passes cannot be transferred and are not refunded or taken back. Your statutory rights remain unaffected. We decide which passes exist and at what price; if we change the price or stop selling them, you keep what you already have. There is no claim to a particular round, fellow players or time.
8oNivo — alerts for timetable changes#
Nivo (winku.de/nivo (opens in a new tab) and the Nivo apps for Android, iPhone, iPad, Mac and watches) keeps an eye on timetables on WebUntis and tells you about changes through the channels you set up. It is free to use; clause 2 applies.
Nivo is a helper. Your school’s timetable always takes precedence. Nivo checks at intervals; changes can arrive late, incomplete or not at all, for example when WebUntis can’t be reached, the school enters them late or the day’s alert limit has been reached. Don’t rely on Nivo alone for anything important.
If you add a WebUntis login, it must be your own or one you are allowed to use; Nivo only uses it to fetch your timetable. Follow your school’s rules for WebUntis. Nivo is not a product of Untis GmbH; Untis and WebUntis are trademarks of Untis GmbH. If Untis changes its interfaces or prohibits access, Nivo may no longer be able to serve some schools or features.
Getting the apps is also subject to the terms of Google Play or the Apple App Store; in the App Store, Apple’s Standard Licensed Application End User License Agreement applies as well. Treat the address of a calendar subscription like a password.
Sharing access with others and trying to get around the service’s limits, for example through mass requests, are not allowed. Nivo may be limited to certain accounts; there is no right to access.
9Liability#
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For simple negligence we are liable only for breach of a material contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, and limited to the foreseeable damage typical for this type of contract. As the programs are provided free of charge, the statutory reduction of liability for gifts additionally applies to them. We are liable for loss of data only to the extent that the loss would not have occurred with proper and regular data backups.
10Changes to these terms#
We may change these terms where required for legal or technical reasons or where new features require it. Changes that relate solely to a new service apply to that service once you use it; changes that only extend your rights apply upon publication. We inform account holders of all other material changes in advance by email or at the next sign-in. They apply to your account only once you expressly agree to them; we ask you for this on your next visit to winku.de (opens in a new tab). Silence or mere continued use does not constitute agreement. As long as you have not agreed, you cannot use your account or the services that require an account; publicly accessible pages such as the legal notice, privacy policy, terms and support remain available. You can agree, sign out or delete your account at any time; as use is free of charge, this costs you nothing.
11Final provisions#
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers may additionally rely on mandatory provisions of their country of residence. Should a provision be invalid, the remainder stays in force. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
